Presentation looks at the major changes to the Western Australian Restraining Orders Act 1997:which took effect from 1 December 2004. Provides background to clarify why certain changes were made and also explores how clients might be affected by the amendments. The Act now distinguishes between domestic and non-domestic situations, the former having broader grounds for granting a violence restraining order (VRO), and the test for a VRO (domestic and non-domestic) is discussed. New legislation also contains a number of child-focused provisions including a requirement that the court consider the need to protect children from family and domestic violence and that oral evidence from a child to the court be given by video link, with the child being allowed the company of a support person. Also discusses new sections dealing with victim support and safety and procedural fairness.
