Notes: | This essay poses the difficult question of how we can begin to move away from punitive reactions to sexual assault, which have consistently failed to increase the safety of women, without sending a message that sexual violence is acceptable. Suggesting it is a contradiction to advocate for justice in an unequal society, the author identifies three steps forward to resolving this dilemma, and utilises 18 juvenile sexual assault case studies from South Australia to illustrate both the potential consequences and benefits of applying restorative justice models to sexual assault situations. Concludes that neither a full endorsement nor disparagement of restorative justice approaches is appropriate, and that we must move beyond the dichotomy of criminal justice versus informal responses as neither adequately address the inequality that underlies gendered violence. |
