Notes:  In 1997 NSW became the first jurisdiction in Australia to specifically protect the confidentiality of the counselling records of complainants in sexual assault matters. A specific category of legal privilege was established to prevent the counselling records of sexual assault complainants from being used in a court unless the court was able to find that it was in the public interest to do so. The legislation is set out in the Criminal Procedure Act 1986 at Pt 5, Div 2.
