Recent amendments to the Family Law Act 1975:(Cth) - the Family Law Legislation Amendment (Family Violence and Other Matters) Act 2011:- give priority to the safety of children in parenting matters before the Family Court. When determining a child's best interests, greater importance is now given to protecting a child from harm. To this end, Independent Children's Lawyers (ICLs) may be appointed as a “best interests” advocate for children. Their specific duties and other obligations are described in s68LA of the Family Law Act 197:and the legal aid commissions’ Guidelines for Independent Children’s Lawyers:.

This resource reports on research commissioned by the Attorney-General's Department which specifically examines how Independent Children's Lawyers (ICLs) are used in the family law system and the degree to which their involvement improves outcomes for children.
