This report of the New South Wales Legislative Council’s Select Committee on the Partial Defence of Provocation summarises the inquiry it conducted into the validity of a reduced sentence in situations where a male partner kills his female partner, claiming provocative circumstances. The Committee was set up in June 2012 following the killing of Manpreet Kaur by her husband, Chamanjot Singh in Sydney.
After extensive consultation the inquiry has resulted in the development of a reform model which endeavours to restrict the availability of the defence of provocation. Reform of this legal defence rather than its abolition was chosen because it is recognised that for some defendants, primarily women who have been long term victims of domestic violence, the use of the partial defence of provocation may be an appropriate legal choice.
