This is the final report of former Family Court judge, Professor Richard Chisholm, following his inquiry into the appropriateness of legislation, practice and procedures relating to family violence in the Family Courts of Australia. The report points to a need for better detection of family violence cases and amendment of provisions in the existing legislation which discourage disclosure. Critically, the report notes the misapprehension surrounding the 2006 legislative reforms that view that parents have a ‘right’ to equal shared care of children, even in cases of family violence. The report recommends amendments to the 2006 reforms that would require the court to consider which of the available parenting options in each case would be best for the child.
