Notes:  This is a US Judge’s Guide on how to deal with and how to evaluate custody and visitation in cases with domestic violence. It is designed to be a tool for judges on how to order, interpret and act on child custody evaluations, which includes references to bench cards and supplementary materials, in order to assist judges in the US to review the expert testimony of child custody evaluators, assess whether the testing methods were reliable where domestic violence is involved. It includes the definition of domestic violence.

The ethical context of safety for victims of domestic violence and their children is explained, including the 3 contexts in which concerns about safety can be addressed:

It provides guidance on ordering an evaluation for domestic violence expertise in situations when there are no resources for an evaluation and on when to make an order for an emergency or interim assessment. It identifies sources of information and evaluation, who are the experts, and the specific information needed from them. It also gives guidance on how to read the expert’s report and whether to admit the report into evidence, and how to assess the report’s recommendations
