Prepared as part of three-year research and consultation project undertaken by the Victorian Law Reform Commission (VLRC), this options paper presents the findings of the VLRC’s study of homicide prosecutions and the use of full and partial defences in homicide cases, and discusses options for reform to existing criminal defences to homicide in Victoria. The defences and partial excuses of self-defence, mental impairment, diminished responsibility, provocation and infanticide are outlined in detail and potential avenues for reform to both the legislative and procedural aspects of these defences are considered. Key problems with existing criminal defences are summarised and a series of questions is posed to stimulate debate amongst professionals and encourage submissions from stakeholders.
