Title: | Negotiating child residence and contact arrangements against a background of domestic violenceWorking Paper Series |
Authors: | Kaye, Miranda Tolmie, Julia Stubbs, Julie |
Keywords: | Family law;Post-separation violence |
Year: | 2003 |
Publisher: | Griffith University Families, Law and Social Policy Research Unit |
Notes: | This report explores the experiences of 40 women who have experienced domestic violence and been required to negotiate child contact and residence with their abusive ex-partner. The responses of the legal institutions and their practitioners and the consequences of the contact are also discussed. Some of the findings reveal that the abuse continued after separation in most of the cases; and that contact or contact negotiations contributed to the violence prolongation. In relation to the legal response, Apprehended Domestic Violence Orders were assessed as difficult to obtain and ineffective; the legal aid funding as insufficient; and the Family Court Hearings as intimidating and disempowering. Professionals involved in the child contact arrangements also provided information for this study. |
