Notes:  This report represents the culmination of a cooperative initiative between Commonwealth, State and Territory governments to establish best practice in domestic violence legislation across Australia. The report draws on the best features of domestic violence legislation from each State and Territory, and contains innovative features. A central proposal incorporates the Commonwealth Government’s CrimTrac initiative, which will enable the immediate registration of all Australian domestic violence orders on a nationwide database and provide protection for domestic violence victims wherever they travel within Australia. The same proposal also calls for the registration of New Zealand domestic violence orders. Other key recommendations in the report include: creating a consistent basis across Australia of grounds for obtaining a domestic violence order; access to telephone initiated domestic violence orders in emergency situations; arrest and temporary detention of domestic violence perpetrators where it is considered necessary to ensure the safety of victims; closure of courts when children are involved in domestic violence proceedings; adoption of the best features of State and Territory domestic violence legislation; and seizure of firearms from domestic violence perpetrators, in accordance with APMC agreement.
