Notes:  This Victorian Law Reform Commission’s Interim Report makes recommendations to confer powers on Victoria Police to remove, hold and detain persons waiting for an application for an interim family violence intervention order. This type of power has been introduced into every other Australian jurisdiction. This Interim Report considers the significance of family violence to assess whether an extension of police powers is beneficial to victims and the legal impediments that police face in seeking intervention orders during crisis situations, which can expose victims to further violence. Safeguards for a person detained by police including those from marginalised groups are also considered. A general introduction and background in responding to family violence through the legal system are provided. The case for reform for police holding power is made, including views from submissions, issues for Indigenous people and other marginalised groups and international standards. The police holding power framework is outlined, such as checks and balances, individual rights protection and independent monitoring and police liability. Other Australian detention power provisions, Victorian Police Family Violence Code of Conduct Chart and consultation paper submissions are also given in the Appendices
