Notes: | This paper proposes reforms within the legal environment that are more responsive to complainants, while balancing the rights of the accused. NSW Police convened the NSW Adult Sexual Assault Interagency Committee and out of its Legal Issues Subcommittee, the concern with low prosecution and conviction rate in sexual assault led to this review and to identify areas for law reform with regard to sexual assault. Comparative research across national and international jurisdictions and literature review were conducted. It is divided into examining evidential issues; jury directions; court procedure; and scope of sexual assault provisions. |
