Developed in response to concerns regarding the current family law system, child support agencies and the position of children in separating families, this report presents the findings of the recent inquiry conducted by the House of Representatives Standing Committee on Family and Community Affairs into these issues. A background to Pt VII of the Family Law Act and an overview of research into the changing nature of Australian families is provided before the findings of the inquiry itself are discussed. Key issues raised by the report include the need for legislative reform, problems with shared parenting arrangements and the mediation of parenting disputes, barriers created by the adversarial nature of the legal system and options for constitutional change, the need for recognition of the role of family members other than parents in children’s care and the need for improving the current system of child support. An important recommendation advanced by the committee was that Part VII of the Family Law Act be amended so as to create a presumption against shared parenting where family violence, child or substance abuse is an issue.
