Prepared by the Family Law Council, this report examines the interaction between the Family Law Act 1975 (Cth) and State child and family legislation, exploring the roles, practices and procedures of the agencies responsible for implementing these laws and providing related services. The first three chapters introduce the role of Family Court in child protection issues and the protocols that are followed where child abuse is raised in court proceedings. The responsibilities of State child protection systems are also examined and the problems which arise in coordinating each level of intervention are highlighted. A proposal is then made for the establishment of a Federal child protection service and strategies for improving the coordination of services and courts in various jurisdictions are outlined. The final chapter addresses the issue of confidentiality and admissibility of certain forms of evidence in the context of family law proceedings and a series of recommendations for reform are made.
