This second discussion paper is part of an effort aimed at improving the States' and Territories' and Commonwealth response to children involved in Family Court matters. The paper describes the legislative and structural child protection regimes at Commonwealth and State/Territory levels. Then, the overlapping jurisdiction issue between both legislative regimes is addressed with a particular focus on family violence orders. Some of the consequences of and approaches to dealing with incidents of overlaps are examined. Finally, a number of proposals for reform including a unified federal jurisdiction, unified state family courts, dual commissions, cross-vesting and accrued jurisdiction are discussed.
