Notes:  Describes children’s experience of domestic violence, the effects on children who witness violence, including children’s sense of responsibility for the violence and the ‘flow-on ‘effects, such as disruption of schooling and loss of friends. Explores the adequacy of existing laws and child protection practices to respond to children who are exposed to domestic violence. Canvasses the use of restraining orders and of child protection proceedings in response to this issue. Outlines the risks of child protection intervention, including the possibility of the women being doubly victimised, and argues that state intervention should be sympathetic to the mother’s position. Suggests that orders of the Court be framed in terms of obligations owed by the perpetrator of the violence, rather than the victims, and that the Court’s range of dispositions be limited in cases of exposure to domestic violence, so that removal from home is not an option. Concludes that the tension between protecting children and meeting the needs of battered women can only be resolved by using child protection proceedings in a way which empowers women to bring about change for themselves.
