Notes:  This paper describes the current public debate about the family law system and post-separation parenting. The aim is to stimulate the discussion of where the proposed reform is likely to lead. There is an overview on legal development, policy background, a report of the recent Parliamentary Committee and the Federal Government’s policies in response to that report. The paper discusses in some detail the significance of the Parliamentary Committee report and comments on the Government’s response. The main goal of the Government proposals is examined as involving fathers in post-separation parenting without putting children at risk through three main strategies from the complex set of proposals: legislative standards; less adversarial procedures; and new services.
