Abstract:  This report investigates the use of non-disclosure agreements (NDAs) in resolving out-of-court workplace sexual harassment complaints in Australia, particularly following the Respect@Work Report. It provides an in-depth analysis of how NDAs are used by legal professionals, based on empirical research, including interviews and surveys with 145 sexual harassment legal practitioners across Australia. The report highlights the continued use of strict NDAs, their impact on transparency and victim rights, and offers recommendations for improving legal practices to better protect victims of sexual harassment.
